Your privacy matters. This policy explains what data we collect, why we collect it, and how you can control it. We are committed to transparency and compliance with GDPR, CCPA, and other applicable data protection regulations.
1. Information We Collect
We collect information you provide directly: name, email, payment details, profile information, and identity verification data. We also collect information automatically through cookies and similar technologies, including IP address, browser type, device identifiers, pages viewed, and referring URLs. For Creators, we may collect biometric data (facial geometry, voice prints) solely for the purpose of likeness verification, with your explicit consent.
2. How We Use Your Information
We use your information to: operate and improve the platform; facilitate transactions between Creators and Brands; verify identities and prevent fraud; communicate with you about your account, transactions, and updates; comply with legal obligations; and personalize your experience. We process biometric data only with your explicit consent and solely for identity verification purposes.
3. Information Sharing
We share your information with: other users as necessary to facilitate transactions (e.g., a Brand may see a Creator's display name and portfolio); payment processors to complete transactions; identity verification providers; hosting and infrastructure providers; and as required by law or legal process. We do not sell your personal information to third parties.
4. Data Retention
We retain your personal information for as long as your account is active or as needed to provide services. Transaction records are retained for a minimum of seven years for tax and legal compliance. Upon account deletion, we will remove your personal information within 30 days, except where retention is required by law. Biometric data is deleted within 90 days of account closure or consent withdrawal.
5. Your Rights
Depending on your jurisdiction, you may have the right to: access the personal information we hold about you; request correction of inaccurate data; request deletion of your data; object to or restrict certain processing; data portability; and withdraw consent. To exercise these rights, contact privacy@hyperknown.com. We will respond within 30 days (or as required by applicable law).
6. Cookies and Tracking
We use essential cookies to operate the platform, analytics cookies (PostHog) to understand usage patterns, and optional marketing cookies for attribution. You can manage cookie preferences through our cookie banner. Essential cookies cannot be disabled as they are necessary for the platform to function. We honor Do Not Track browser signals.
7. International Data Transfers
Your information may be transferred to and processed in countries other than your own. We use Standard Contractual Clauses (SCCs) and other appropriate safeguards to protect your data during international transfers. For EU/EEA residents, we comply with GDPR requirements for cross-border data transfers.
8. GDPR (European Economic Area)
If you are located in the EEA, our legal bases for processing include: performance of a contract (to provide the Service); legitimate interests (fraud prevention, platform improvement); consent (marketing communications, biometric processing); and legal obligation (tax reporting, law enforcement requests). You may lodge a complaint with your local Data Protection Authority.
9. CCPA (California Residents)
California residents have the right to: know what personal information is collected, used, shared, or sold; delete personal information held by businesses; opt out of the sale of personal information; and non-discrimination for exercising these rights. 10. Updates to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated policy.
